Court sentences ex-convict to 7yrs imprisonment for stealing mattress


CourtA Magistrate Court, sitting in Osogbo, on Monday sentenced a 25 year old ex-convict, identified as Abideen Damilola to seven years imprisonment for stealing 21 inches mattress, worth N70,000.

The convict was docked on two count charges, bothering on house breaking and a felony to wit stealing.

The Police prosecutor, Inspector Olayiwola Rasaq informed the court that the convict committed the offence in June 2018 at Alare community, around Ota Efun area in Osogbo by breaking into the residence of one Aderanti Ganiyu.

According to him, items stolen by the convict include 21 inches mattress estimated at N70,000 rug carpet worth N15,000, two big coolers, one 6kg gas cylinder valued at N10,000 and two pillows worth N3,000.

Rasaq recalled that the convict who had hitherto been jailed for stealing honey in Ede community was challenged by the complainant when he attempted to steal the items, with the thinking that the owner was not at home, adding that all items were recovered and tendered in court as exhibits.

He further explained that the offences contravened Section 413, Section 383 and punishable under Section 390 of the Criminal Code, Cap 34, Volume 11, Laws of Osun State, 2003.

The convict, however, pleaded guilty to the two count charges of housebreaking and a felony to wit stealing.

Delivering her judgment, the presiding Magistrate Falilat Sodamade sentenced Abideen Damilola to seven years jail term on the first count charge and seven years imprisonment on second count charge, adding that the sentences should run concurrently.

She also ordered that the exhibits should be returned to the owner on bond after 30 days.
