Inmates charged in Mario Dean case to face Home Circuit Court June 29


The case surrounding the three men charged with the beating death of Mario Deane while in police custody in 2014 has been put off to the June 29.The case was temporary transferred to the Home Circuit Court in April as a result of Justice Viviene Harris, who has been dealing with the case since January in the St James Circuit Court, moving on to the Home Circuit Court.

The three men are: Damion Cargill, Marvin Orr and Adrian Morgan.

A seven-member jury in the St James Circuit Court ruled Cargill, who is deaf, mute and schizophrenic, unfit to plea on Monday, March 20.

Cargill’s attorney, Franklin Halliburton said there were challenges in producing a probation report requested for Cargill. It is understood that one of the report to be done is from a doctor who had testified during the fit to plea hearing in March. The doctor is said to be off the island.

As a result, Justice Harris was unable to make her decision known yesterday as to whether Cargill will be sent to a state facility or allowed supervised care with his family as stated under section 25c of the Criminal Justice Administration act.

Meanwhile, outstanding medication records for the other two men, Orr and Morgan, who are also schizophrenic, had led to an expected setting of a trial date being postponed to June 29.

Mario Deane is the 31-year-old construction worker who was taken into custody at the Barnett Street Police station in St James by the police for the position of a ganja spiff on Sunday, August 3, 2014.
However, Dean died three days later (August 6) in hospital after receiving severe injuries to the head while in custody.

  4. All now the JCF don’t hold the officers accountable for wrongfully detaining the man after he had made bail. At least in the US his family could bring acivil lawsuit against them.
